By accessing or using Apex Omnis ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

Apex Omnis is a marketplace platform that enables users to create, publish, and sell intelligence reports and knowledge collections. The Platform may use artificial intelligence to assist in content creation and analysis.

3. AI-Powered Features and Limitations

AI Models and Capabilities

The Platform utilizes third-party large language models (LLMs) including GPT-4 and similar AI systems to:

  • Content Transformation: AI-assisted conversion of project deliverables into intelligence reports (requires human review)
  • Earnings Forecasts: Statistical projections using linear regression on historical data (not financial advice)
  • Email Summaries: Automated digest generation from platform activity

AI Limitations and Disclaimers

IMPORTANT: AI-generated content may contain errors, inaccuracies, or hallucinations. Users are solely responsible for reviewing, verifying, and validating all AI-assisted content before publication or use.

  • Not Financial Advice: Earnings forecasts are statistical estimates based on historical data. Past performance does not guarantee future results. Do not rely on forecasts for investment or business decisions without consulting qualified professionals.
  • Accuracy Not Guaranteed: AI models may produce incorrect, incomplete, or biased outputs. Apex Omnis does not warrant the accuracy of AI-generated content.
  • Human Oversight Required: All AI-assisted features require human review and editorial control. You retain full responsibility for published content.
  • No Discrimination Guarantee: While we implement bias mitigation measures, AI models may inadvertently produce discriminatory outputs. Report any concerns immediately.

Prohibited AI Uses

You may not use the Platform's AI features to:

  • Create deepfakes, synthetic media, or misleading content
  • Generate election-related misinformation or disinformation
  • Produce content that violates laws in Colorado, California, or other jurisdictions with AI regulations
  • Circumvent AI disclosure requirements or misrepresent AI-generated content as human-created

Regulatory Compliance

Apex Omnis complies with applicable AI regulations including the Colorado AI Act (SB 24-205) and EU AI Act where applicable. Service availability may be restricted in certain jurisdictions to comply with local AI laws. We align with NIST AI Risk Management Framework best practices.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Content Ownership and License

You retain all ownership rights to content you upload to the Platform. By uploading content, you grant Apex Omnis a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display your content solely for the purpose of operating and promoting the Platform.

6. Prohibited Content

You may not upload, publish, or sell content that:

  • Infringes on intellectual property rights
  • Contains illegal, harmful, or offensive material
  • Violates privacy rights or confidentiality obligations
  • Contains malware or malicious code

7. Payment Terms

Payments are processed through Stripe. Apex Omnis charges a platform fee on each transaction. Payouts are subject to Stripe Connect terms and may take 2-7 business days to process.

8. Refund Policy

Digital products are generally non-refundable. Refunds may be granted at the seller's discretion or in cases of technical issues preventing access to purchased content.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX OMNIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

11. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
